The Local – International Joint mission issuing the 2nd report to the evaluation of Legislative environment reform stage "the Constitutional restrictions and he aspirations of the partisan powers"

In the frame work of the announcement of the Local- International joint mission to observe the Parliamentary elections – Egypt 2015, of continuing its work in observing the Parliamentary elections after the judgment of the Constitutional Court, the mission monitoring and evaluating the on -going reforms in the legislative and procedural environment, the Parliamentary Observatory affiliated to the Local- International Joint Mission issued its 2nd report which included presenting the legislative and governmental actions which the government conducted it for the reforming the districts division law, and the parties and the political powers' reaction of these actions.
The mission indicated in its report that the (official and public) bodies and committees engaging in the law reform or providing proposals, are governed by the developed constitutional articles No 243 ,244 of the Egyptian Constitution, which was approved in January 2014.
The report monitored the completion of the Committee of reforming the parliamentary election laws, its work for the second week, also the report monitored that some political powers and public figures composing a public committee to reform the Legislative and electoral environment, voluntarily to express their suggestions and the party's proposals to amend the parliamentary election laws.
The mission indicated in its report that there are a good indicators of the existence of a state of a positive movement toward reforming the organization laws of the electoral process, whether at the level of the official state bodies or at the level of the components of civil society organizations (partisan and non-partisan), the Mission highlighted the following points;
1- The committee of the parliamentary elections laws reforming, which was composed by the decision of the Prime Minister, using of constitutional experts from outside is a positive point, meet the demanded by the mission and others concerned with the electoral Egyptian process, To ensure avoiding the constitutional appeals against the legislation governing the electoral process.
2- The existence of civilian movement related to developing the elections laws, this time is a mature movement, where some of the civil and political powers managed to form a parallel committee to reform the legislation, including important experts and have a long history in the electoral affairs, it's important that the committee of reforming the lows, assigned by the Egyptian prime minister decision, to seek to the effective communication with this parallel committee as expressing of a wide range of partisan powers and civil society organization.
3- The mission emphasizes the need to seriously considered the proposed by the Committee of reform the legislative structure for elections ( the independent committee), which related with engaging political figures reflect the colors of the political spectrum in the official committee assigned by the prime minister decision.
4- The number of the proposals submitted to the committee to reform the law is (120 proposal), which indicating that the most of the political powers involved in the legislation reforming process, which requires from the Committee the necessity to declare a transparent mechanism to discuss all these proposals and to engage in serious dialogue with the owners.
5- The main point which the committee see that it is witnessing a disagreement between the Committee on the one hand, and the partisan powers of the other hand, it is regarding the scope of the reformation, the committee moving within the limits of the Constitutional Court judgment and focused almost entirely on the electoral districts division law, while the most of political powers seeing the need to widening the scope of the reformation to include the House of Representatives law also, the mission emphasizes the need to reconsider the argument posed by the Committee and the adoption of a holistic view of the legislation governing the electoral process, in order to narrowing the gap between the aspirations of the political powers on the one hand, and the capabilities of the Committee and constitutional text limitations on the other hand.
6- The mission emphasizes that the two articles 243 and 244 of the Egyptian Constitution posing a constitutional constraint may not be supportive to proposals and aspirations of some of the political and partisan powers, which demanding to make significant changes to the assigned division ratios to each of the individual system seats and the system of closed lists, as well as the difficulty of accommodating the constitutional text for expansion in the proportional lists system that achieve greater justice in the distribution of seats, so the poth committees the assigned by the prime minister decision and the independent have to deal more realistically with these proposals and to familiarize the public in a transparent systematic way about the challenges that might hinder the implementation of some of these proposals.
7- TheLocal- International joint mission emphasizes the necessity of using the specialists experts in statistics Science, and the demography science, during the legislation governing the electoral developing process.
It is worth mentioning that ,the International-Local Joint Mission to Observe the Parliamentary Election –Egypt 2015, Is a coalition consist of the Global Network for Rights and Development - GNRD (Norway) and the International Institute for Peace, Justice and Human Rights – IIPJHR (Switzerland), along with a key local partner represented in MAAT for Peace, Development and Human Rights (MAAT) addition to 31 local Organization.
