Preface

يرصد هذا التقرير مدي الالتزام بتنفيذ التوصيات التي قبلتها الحكومة المصرية خلال خضوعها لعملية المراجعة الدورية الشاملة، التي اعتمد تقريرها الختامي في مارس 2015، حيث قدمت للحكومة المصرية 300 توصية قبلت الحكومة المصرية طوعا 224توصية علاوة على موافقتها الجزئية على 23 توصية أخري، وهو ما يعني – حسب الحكومة – إنها ضمنيا توافق على جزء من التوصية أو على الغاية منها وإن الاختلاف قد يكون على طريقة التنفيذ أو المدى الزمني  المقترح لتنفيذ التوصية، في حين رأت الحكومة في 29توصية أخرى إنها موضع تطبيق فعلى، فاكتفت بأخذ العلم بها، فيما تحفظت على 24 توصية بدعوى التعارض مع الدستور أو عدم الدقة.

وقد قدم التحالف ثلاث تقارير سابقة لرصد ومتابعة مدى التزام الحكومة المصرية بتنفيذ التوصيات التي قبلتها كليا وجزئيا بشكل طوعي، ويغطي هذا التقرير التطورات ذات الصلة بحقوق الإنسان خلال الفترة من يوليو إلى ديسمبر 2017.

خلال الفترة التي يغطيها التقرير شهدت مصر مجموعة من الاحداث، منها بداية دور الانعقاد الثالث لمجلس النواب في شهر أكتوبر 2017، والذي شهد مناقشة عدد من مشروعات القوانين التي تتعلق بتوصيات الاستعراض الدوري الشامل، كما شهدت هذه الفترة تحسن طفيف في مؤشرات الاقتصاد المصري أدي إلى تثبيت سعر الصرف وعدم ارتفاع أسعار السلع، وذلك بعد التراجع الذي سُجل خلال الفترة الماضية نتيجة تنفيذ الحكومة برنامج الإصلاح المالي عن طريق حزمة من الإجراءات الاقتصادية، بالاتفاق مع صندوق النقد الدولي. كما واجهت مصر خلال نفس الفترة خطر الإرهاب الذي يعد أحد أهم تحديات احترام حقوق الإنسان في إطار موجه عالمية لتنامي المد الإرهابي، والذي شهد لأول مرة استهداف مسجد مكتظ بالمصلين مما يمثل تغير نوعي في الفكر الإرهابي على خلاف باقي العمليات التي شهدتها مصر خلال الفترة الماضية.

من جانب آخر شهد الفترة التي يغطيها التقرير استجابة الحكومة لما طالب التحالف به منذ فترة بخصوص تشكيل وتفعيل آلية وطنية لمتابعة تنفيذ التوصيات، حيث صدر قرار رئيس مجلس الوزراء رقم 2457 لسنة 2017 بتوسيع عضوية اللجنة الوطنية المعنية بآلية الاستعراض الدوري الصادرة بالقرار 37 لسنة 2015، حيث تم ضم ممثلين للمجتمع المدني من بينهم الأمين العام للتحالف.

منهجية التقرير

اعتمد التقرير في منهجيته على رصد ومتابعة مدى التزام الحكومة المصرية بتنفيذ توصيات الاستعراض الدوري الشامل التي قبلتها في مارس 2015، وذلك خلال الفترة من يوليو -ديسمبر 2017، حيث اعتمدت عملية الرصد على إبراز المعلومات التالية: –

1.    القضايا موضع الصلة بالتوصيات (25 موضوع)، وكذلك عدد التوصيات المنبثقة عن كل قضية.

2.    The constitutional framework relevant to each issue.

3.    Legal developments.

4.    Gaps in the legal and institutional system.

5.    The most important statistics and facts related to the issues subject to the recommendations.

وقد اعتمد التقرير في معلوماته على مخرجات العملية التشريعية، والقرارات والإجراءات والتصريحات الحكومية الرسمية، فضلا عن الإفادات والتقارير الفرعية التي تم تلقيها من أعضاء تحالف منظمات المجتمع المدني من أجل الاستعراض الدوري الشامل، حيث قامت لجنة منبثقة عن التحالف بمراجعة المعلومات وتصنيفها وتحليلها تمهيدا لتحرير التقرير الحالي.

وسوف نعرض فيما يلي تقييما لمدى التقدم في الجوانب المختلفة لحقوق الإنسان، والتي كانت موضوعات لعدد كبير من التوصيات المقدمة للحكومة المصرية خلال خضوعها للمراجعة الدورية الشاملة وهي كالتالي:

1.    تعزيز جهود مكافحة الارهاب

قُدمت إلى الحكومة المصرية في هذا الشأن 6 توصيات متعلقة بتعزيز جهودها في مكافحة الإرهاب، وقد قبلت الحكومة المصرية كل هذه التوصيات، وينص الدستور المصري في المادة 237، على أن “تلتزم الدولة بمواجهة الإرهاب، بكافة صوره وأشكاله، وتعقب مصادر تمويله، وفق برنامج زمني محدد، باعتباره تهديدًا للوطن وللمواطنين، مع ضمان الحقوق والحريات العامة. وينظم القانون أحكام وإجراءات مكافحة الإرهاب والتعويض العادل عن الأضرار الناجمة عنه وبسببه”.

على الرغم من ان مصر تمر بموجه عنيفة من العمليات الإرهابية خلال السنوات الأخيرة، منذُ سقوط نظام الاخوان، والتي تستهدف القوات المسلحة والشرطة والمنشآت العامة والخاصة، والمدنيين من الاقباط والمسلمين، وهي العلميات التي أودت بحياة عدد كبير من المواطنين المصريين، دفعت الحكومة إلى استمرار فرض حالة الطوارئ في مختلف أنحاء البلاد، إلا انه خلال الفترة التي يغطيها التقرير شهدت مصر الهجوم الأكثر دموية التي تتعرض له على مر التاريخ وذلك عندما تم استهداف مسجد  ببئر العبد  بمحافظه شمال سيناء  أثناء صلاة الجمعة، مما أدي إلى سقوط عدد كبير من المصليين من بينهم أطفال، ويمكن ذكر أهم هذه الوقائع فيما يلي:

§        في 24 نوفمبر 2017، وعند بدء إلقاء خطيب مسجد الروضة لخطبة صلاة الجمعة، غربي مدينة العريش، شرق بئر العبد شمال سيناء، فوجئ المصلون بقيام عناصر تكفيرية يتراوح عددهم من 25 -30 عضو تكفيري يرفعون علم داعش، وقد اتخذوا من باب المسجد ونوافذه البالغ عددها 12 نافذه يحملون الأسلحة الآلية وأخذوا في إطلاق الاعيرة النارية على المصلين بطريقة عشوائية مستخدمين 5 سيارات دفع رباعي وقاموا بإضرام النيران في 7 سيارات تابعة للأهالي، مما أدي إلى سقوط ما لا يقل عن 305 شهيداً بينهم 27 طفلاً و 128 مصاباً –وفقاً لمصادر رسمية- ، كما تم استهداف طواقم الإسعاف التي حضرت لنقل المصابين. ويأتي هذا العمل الارهابي، بعد هدوء نسبي للعمليات المسلحة شمال سيناء ضد قوات الجيش والشرطة، وتعتبر تغييرا نوعيا نادرا عبر استهداف مسجد منذ انطلاق المواجهات العسكرية لعناصر مسلحة في عام 2013. وأكّدت تقارير اعلامية، أن المسجد المستهدف هو الوحيد في قرية الروضة ويرتاده المئات من أهالي القرية.

§        في 20 أكتوبر 2017، قامت عناصر إرهابية باستهداف قوات الشرطة في منطقة الكيلو 135 بطريق الواحات، مما أسفر عن استشهاد 16 من قوات الشرطة وإصابة 13 آخرين، فيما قُتل وأصيب 15 من العناصر الإرهابية. وكانت معلومات وردت لقطاع الأمن الوطني المصري تفيد باتخاذ بعض هذه العناصر الإرهابية للمنطقة المتاخمة للكيلو (135) على طريق الواحات بعمق الصحراء مكاناً لاختبائها، وتم إعداد مأمورية لمداهمة تلك العناصر، وحال اقتراب القوات واستشعار تلك العناصر بها أطلقت الأعيرة النارية تجاهها، وبادلتها القوات بإطلاق النيران، ما أسفر عن استشهاد وإصابة عدد من رجال الشرطة ومصرع عدد من هذه العناصر.

§        في 9 أغسطس 2017، استهدف مسلحين سيارة أمنية على طريق العريش الأمر الذي أدي إلى مقتل ضابط وثلاث أفراد من الشرطة.

§        وفي 8 أغسطس 2017، قام مسلحين باستهداف أحد الكمائن المرورية الثابتة بالظهير الصحراوي لمحافظة قنا/ جنوب مصر، والتي راح ضحيتها ضابط وعدد من الجنود.

§        وفي 14 يوليو 2017، قاموا مسلحون ملثمون يستقلون دراجة بخارية بإطلاق النيران على كمين الشرطة السياحي المتواجد بقرية أبو صير بمركز البدرشين بمحافظة الجيزة مما أسفر عن استشهاد 5 من قوات الشرطة.

§        وفي 7 يوليو 2017، استهدف تنظيم داعش الإرهابي كمين “البرث” بجنوب رفح، مما أسفر عن سقوط أكثر من 26 من أفراد القوات المسلحة، ما بين قتيل وجريح. حيث قام انتحاريين بتنفيذ العملية بسيارتين مفخختين استهدفتا الكمين، تبعها هجوم لعناصره بالأسلحة النارية، الأمر الذي ساهم في ارتفاع عدد الضحايا. وفي نفس اليوم تم اغتيال النقيب إبراهيم عزازي ضابط الامن الوطني، عقب خروجه من بيته لأداء صلاة الجمعة في منطقة الجبل الأصفر التابعة لمركز الخانكة بمحافظة القليوبية، وقد أعلنت حركة “حسم” التابعة لجماعة الاخوان مسؤوليتها عن الحادث الإرهابي.

§        وفي 6 يوليو 2017، استهدف مجهولين يستقلون سيارة ميكروباص بإطلاق النيران تجاه أحد التمركزات الأمنية الكائنة أعلى محور 26 يوليو، وبادلتهم قوة الكمين إطلاق النيران وأجبرتهم على الفرار، مما أسفر عن إصابة مجند من قوة الكمين وأحد المواطنين الذي تصادف مروره قرب الحادث، وقد أعلنت حركة “حسم” الاخوانية مسئوليتها عن استهداف الكمين.

§        في 5 يوليو 2017، أطلق مجهولون النار على ضابطين بالمعاش ومجند بقرية البليدة بمركز العياط جنوب محافظة الجيزة، وذلك اثناء تواجدهم بمحطة تحصيل الرسوم بالطريق الإقليمي مما أسفر عن استشهادهم.

§        في 4 يوليو 2017، استهدفت جماعة إرهابية مدرعة شرطة أثناء سيرها في منطقة حي الصفا جنوب مدينة العريش، وأسفر ذلك عن استشهاد ضابط ومجندين وإصابة 11 آخرين وذلك باستخدام عبوة ناسفة.

ويرى تحالف منظمات المجتمع المدني، أن الإرهاب هو المهدد الأول للأمن القومي المصري، وانه يغتال حق من حقوق الإنسان الأساسية إلا وهو “الحق في الحياة” الذي يعد من أسمي وأقدس الحقوق على الإطلاق وان استمرار العمليات الإرهابية مرتبط باستمرار دعم الدول التي تحتضن التنظيمات الإرهابية وتوفر لها المأوي والدعم المادي والمعنوي والاستخباراتي، الأمر الذي ساعد على تنامى قدرات التنظيمات الإرهابية. فالحديث عن مكافحة الإرهاب هو حرب بطيئة تتضمن جوانب متعددة تأتى على رأسها الإطار الثقافي والتعليمي والديني. بجانب الحل الأمني، وتحقيق تلك الجوانب لا يتم إلا بوضع استراتيجية شاملة لمكافحة الإرهاب، والتي تنبع من حوار ومشاركة مجتمعية حقيقية وبيئة سياسية ديمقراطية.

ورغم أن رئيس الجمهورية أصدر قرار بتشكيل المجلس الأعلى لمكافحة الإرهاب، وعقد المجلس بالفعل أول اجتماعاته، إلا إنه لم يكرر هذا الاجتماع ولم يتمخض عن المجلس حتى الآن استراتيجية شاملة لمكافحة الإرهاب، وهو ما يجعل جهود مكافحة الإرهاب ” مجتزأة ” وغير شاملة.

ومن هنا يطالب تحالف منظمات المجتمع المدني بوضع استراتيجية وطنية شاملة لمواجهة الإرهاب والتطرف الديني والفكري، لا تقتصر على الجانب الأمني والعسكري فقط، إنما تشمل أيضا الجوانب الثقافية والتنموية والاقتصادية والاجتماعية، وذلك من خلال مشاركة مجتمعية حقيقية وبيئة سياسية أكثر انفتاحا.

2.    تعزيز حقوق الطفل والاسرة

تلقت الحكومة المصرية 7 توصيات تتعلق بتعزيز وحماية حقوق الطفل والأسرة، وقد قبلتها الحكومة المصرية جميعا. وينص الدستور في المادة 10، على أن “الأسرة أساس المجتمع، قوامها الدين والأخلاق والوطنية، وتحرص الدولة على تماسكها واستقرارها وترسيخ قيمها”. كما تنص المادة 80، على أن “تلتزم الدولة برعاية الطفل وحمايته من جميع أشكال العنف والإساءة وسوء المعاملة والاستغلال الجنسي والتجاري”.

وقد شهدت الفترة التي يغطيها التقرير موافقة مجلس النواب على تعديل قانون إنشاء محاكم الأسرة، حيث تم إضافة فقرة أخيرة للمادة 11 من القانون، لتنص على أنه يجب على الإخصائي الاجتماعي أن يضمن في تقريره -الذي يقدمه للمحكمة عند نظر دعاوي إثبات النسب-بيان ما إذا كان الصغير المرفوع بصدده دعوى إثبات النسب خاضعا لنظام “الأسر البديلة” التابع لوزارة التضامن الاجتماعي أم غير خاضع. ويري البعض ان هذا القانون يتسق مع أحكام ومبادئ الشريعة الإسلامية، ويحافظ على عدم خلط الأنساب، ومتوافق مع أحكام الدستور الذي حرص على حفظ الأسرة من الفساد والاضطراب حتى تقوم على وحدة الدم الذي يعتبر من أقوى الروابط بين أفرادها، وأنه جاء متفقا مع اتفاقية حقوق الطفل.

كما أصدر الدكتور طارق شوقي وزير التربية والتعليم كتابا دوريا رقم 29 بتاريخ 12 نوفمبر 2017، بشأن الضوابط الحاكمة والإجراءات المتبعة حال وجود نزاع بين الوالدين خاص بمسائل الولاية التعليمية، حيث أعطى الوزير الحق للأم في الولاية التعليمية بدون صدور حكم قضائي بذلك وهو ما يعد استجابة مهمة لمطالبات المنظمات الحقوقية في السنوات الأخيرة.

وخلال الفترة التي يغطيها التقرير انتهي المجلس القومي للمرأة من إعداد قانون لمكافحة زواج القاصرات للتصدي لهذه القضية التي ينتج عنها الكثير من المشاكل المجتمعية الخطيرة التي تهدد أمن واستقرار المجتمع، حيث يشكل زواج القاصرات انتهاك واضح لحقوق الطفل وذلك لما يسببه من حرمان الطفل لحقوقه الاجتماعية والنفسية والفسيولوجية وحقه في الرعاية والحماية، ومن أبرز ملامح القانون، تغليظ العقوبة، بحيث يعاقب بالسجن والغرامة من 10 لـ20 ألف جنيه كل من زوج أنثى قبل بلوغها السن القانوني، فضلاً عن مقترح يطالب بسلب الولاية من المحكوم عليه في جناية تزويج قاصرات “أبوها أو عمها” إذا كان الولي الشرعي لها، فضلاً عن إضافة مادة مقترحة لقانون الإجراءات الجنائية بألا تبدأ المدة المسقطة للدعوى الجنائية إلا من تاريخ بلوغ القاصرة سن الرشد.

وفي هذا الإطار أصدر الجهاز المركزي للتعبئة العامة والاحصاء تقرير عن حالات زواج القاصرات في مصر وفقاً للتعداد السكاني حيث أشار التقرير إلى أن عدد المواطنين المتزوجين أقل من 18 عامًا في مصر بلغ 18.3 مليون نسمة، وتمثل حالات زواج القاصرات 14% من إجمالي حالات الزواج في مصر سنويًا، وتصدرت المحافظات الحدودية القائمة بنسبة 23% وبعدها الصعيد، والنسبة الأكبر من زواج الحدث يصل من 30 إلى 40% بالصعيد والقرى والأرياف. كما أوضح التقرير أن أعلى نسبة للمتزوجات أقل من 20 سنة بمحافظة القاهرة 9.1%، وفى الجيزة 8.1%، وفى الشرقية 7.7% في حين كانت أقل المحافظات الحضرية هي محافظات السويس، وبورسعيد بنسبة 0.7%، ويرتفع متوسط عدد الأطفال في حالة الزواج قبل 18 سنة إلى حوالي 3.7 طفل، بينما يكون المتوسط 2.79 في حالة الزواج بعد عمر 22 سنة، ومعدل وفيات الأطفال بالنسبة للفتيات القاصرات 29 لكل ألف مولود، كما توجد أكثر من 200 قضية زواج قاصرات لدي “الأحوال المدنية” سنويا بمعدل 12 قضية شهريا.

وفي انتهاك صارخ لحقوق الطفل شهدت الفترة التي يغطيها التقرير واقعة اعتداء أحد مدرسي كفر غطاطي الابتدائية التابعة لإدارة الهرم بمحافظة الجيزة بالتعدي بالضرب المبرح على أحد التلاميذ، حيث تم كسر العصا على جسم الطفل. كما تعرض 3 أطفال لمحاولة اغتصاب على يد مدير المدرسة المصرية للغات بالنزهة، وقد اتخذت مديرية التربية والتعليم الإجراءات القانونية والإدارية تجاه هذه الوقائع، حيث أمرت بوضع المدرسة تحت الإشراف المالي والإداري للوزارة، وكان قسم شرطة النزهة تلقى عدة بلاغات من أولياء أمور تلاميذ في مدرسة خاصة يتهمون فيها المدير باغتصاب أطفالهم داخل المدرسة، وانتقلت الأجهزة الأمنية وألقت القبض على المتهم، وتحرر المحضر اللازم بالواقعة، وأخطرت النيابة العامة للتحقيق.

ويواجه الأطفال العديد من الانتهاكات، منها حرمان من التعليم بشكل جاد، عدم وجود الرعاية الصحية والنفسية والاهتمام اللازم بها، كذلك عمله في سن مبكر مما يعرضه للتعدي اللفظي والجنسي.

ويري التحالف أن هناك حاجة ماسة لإصلاحات تشريعية وإجرائية للتغلب على ظواهر استغلال الأطفال ومحاصرة ظاهرة أطفال الشوارع، فضلا عن التغلب على مشكلة عمالة الأطفال في الأعمال الخطرة، وهو ما يستلزم تعديل قوانين الطفل، وتشديد العقوبات على من ينتهك حقوق الأطفال، وضرورة استقلال المجلس القومي للطفولة والأمومة وإلغاء تبعيته من وزارة الصحة وتعود إلى رئاسة مجلس الوزراء حتى يقوم بدوره في التنسيق بين الجهود المختلفة دون أي عوائق.

3.    Supporting people with disabilities

The Egyptian government received 9 recommendations related to supporting the rights of persons with disabilities, and the Egyptian government accepted 8 recommendations completely, and took note of only one recommendation.

يعتبر دستور 2014 الأكثر إرضاءً لذوي الاحتياجات الخاصة نسبيًا عن السبعة دساتير التي سبقته، فقد حوى 4 مواد صريحة في هذا الصدد من أصل247، علاوةً على عدد آخر من المواد الداعية للمساواة والعدالة الاجتماعية وعدم التمييز في الحقوق الإنسانية وغيرها، إذ دعت المادة 53 إلى عدم التمييز على أساس الإعاقة للمواطنين أمام القانون وأن الجميع متساوون في الحقوق والحريات والواجبات العامة.بينما تحدثت المادة 55 عن ضرورة تكفل الدولة بتوفير الإتاحة لمن يقبض عليه من ذوي الاحتياجات الخاصة مع ضرورة الحفاظ على كرامته وعدم جواز تعذيبه أو ترهيبه وإكراهه أو إيذائه بدنيًا أو معنويًا ويتم احتجازه في أماكن مخصصة لذلك لائقة إنسانيًا وصحيًا، واشترطت معاقبة من يخالف ذلك باعتبارها جريمة، المادة 80 ألزمت الدولة بكفالة حقوق الأطفال ذوى الإعاقة وتأهيلهم وإدماجهم في المجتمع، كما ألزمتها بضمان حقوقهم الصحية والاقتصادية والاجتماعية والثقافية والترفيهية والرياضية والتعليمية مع ضمان فرص عمل لهم وذلك وفقًا للمادة 81.

كما أعلن رئيس الجمهورية أن عام 2018 سيكون عام ذوي الاحتياجات الخاصة. وجاء هذا الإعلان في مؤتمر الشباب الثالث الذي عقد بمحافظة الإسماعيلية في إبريل 2017.

وأثناء كتابة هذا التقرير وافق البرلمان على قانون “حقوق ذوي الإعاقة” والذي يعد خطوة هامه نحو حصول ذوي الإعاقة على حقوقهم الذي طال انتظارها، وتنص المادة 37 من القانون على أن ” تلتزم الدولة بتمتع الأشخاص ذوي الإعاقة بكافة الحقوق السياسية التي يتمتع بها الآخرون وتتخذ الجهات المعنية الإجراءات الخاصة بعمليات الترشح والتصويت في الانتخابات والاستفتاءات بجميع أنواعها والأدوات الكفيلة بإتاحة وتيسير مشاركة الأشخاص ذوي الإعاقة في هذه العمليات، بما في ذلك الحق في الاستعانة عند الاقتضاء بمرافقين أو مساعدين يختارهم هؤلاء الأشخاص”. كما نصت المادة 38 على أن “تضمن الدولة الحرية اللازمة للأشخاص ذوي الإعاقة في إنشاء أو الانضمام إلى المنظمات أو الاتحادات النوعية والإقليمية الخاصة بكل إعاقة وفقًا لأحكام القانون بما يضمن تمثيلهم على الصعيدين المحلي والدولي وتلتزم الأحزاب السياسية ومنظمات المجتمع المدني والاتحادات والنقابات بإتاحة وتيسير وتشجيع مشاركة الأشخاص ذوي الإعاقة في كافة صور أنشطتها بتمثيل مناسب”. كما يمنح القانون الجديد بعض الامتيازات والحوافز الضريبية لأصحاب العمل في حالة توظيف ذوي الإعاقة بالمؤسسات.

كما شهدت الفترة التي يغطيها التقرير صدور قرار رقم 252 من وزير التربية والتعليم بشأن قبول التلاميذ ذوي الإعاقة البسيطة بمدارس التعليم العام، وقد نص القرار على أن يطبق نظام الدمج للطلاب ذوي الاعاقة البسيطة بالفصول النظامية بمدارس التعليم العام الحكومية، والمدارس الخاصة، ومدارس الفرصة الثانية، والمدارس الرسمية للغات، والمدارس التي تدرس مناهج خاصة في جميع مراحل التعليم قبل الجامعي ومرحلة رياض الأطفال ، وبما يختاره ولي أمر الطفل ذي الإعاقة في إلحاق طفلة بمدرسة دامجة أو مدرسة تربية خاصة ، وتلتزم المدارس التي تطبق هذا النظام بالإعلان عنه داخل وخارج المدرسة.بالإضافة إلى القرار رقم (291) لسنة 2017 بإنشاء مدارس وفصول التربية الخاصة؛ من أجل تقديم نوع من التربية يتناسب مع الطلاب ذوي الاحتياجات الخاصة.

ورغم أهمية صدور هذا القرار، إلا أن هناك عدد كبير من المدارس والمدرسين غير مؤهلين للتعامل مع هؤلاء الطلبة، حيث ان المدارس ليس لديها معلمون حاصلون على دورات تأهيلية ولا مدربون على التعامل مع هؤلاء الأطفال، مما قد يؤثر بالسلب على نفسيتهم.

وبالتالي يري تحالف منظمات المجتمع المدني بضرورة تجهيز المدارس لاستقبال الطلاب ذوي الاعاقة، وأيضا تدريب المعلمين على التعامل مع الأطفال ذوي الإعاقة في حالة الدمج، وتوفير تقنيات حديثة تساعد في تعليم هؤلاء الأطفال حتى يحصلوا على الاستفادة القصوى من هذا الدمج. كما يطالب التحالف توفير بيئة ملائمة للأشخاص ذوي الإعاقة لممارسة حياتهم بصورة ميسرة في كافة المجالات العملية والرياضية وحتى الترفيهية والبدء في تأهيل المباني الخدمية بمختلف أنواعها لتكون صديقة للأشخاص ذوي الإعاقة.

4.    Combating violence against women

The Egyptian government received 28 recommendations related to combating violence against women. The Egyptian government accepted 25 recommendations fully, and 3 recommendations partially accepted.

ينص الدستور المصري في المادة 11 على أن “تلتزم الدولة بحماية المرأة ضد كل أشكال العنف، وتكفل تمكين المرأة من التوفيق بين واجبات الأسرة ومتطلبات العمل. كما تلتزم بتوفير الرعاية والحماية للأمومة والطفولة والمرأة المعيلة والمسنة والنساء الأشد احتياجًا”.

وخلال فترة كتابة التقرير شارك المجلس القومي للمرأة وعدد من المنظمات النسوية الاحتفال باليوم العالمي للقضاء على العنف ضد المرأة والذي يوافق 25 نوفمبر من كل عام، وحملة الـ 16 يوما من الأنشطة المناهضة للعنف ضد المرأة التي أطلقتها منظمة الأمم المتحدة ، والتي تبدأ من يوم 25 نوفمبر و حتى الـ 10 من ديسمبر الذي يوافق اليوم العالمي لحقوق الإنسان، حيث تهدف الحملة الى رفع الوعي وخلق رأي عام مساند في كل مكان لإحداث التغيير ومناهضة كافة اشكال العنف الموجهة ضد المرأة والفتاة وتسليط الضوء على هذه المشكلة ودعوة المجتمع المحلي والدولي للسعى نحو ايجاد حلول جذريه لها.

كما أطلق المجلس العديد من الفعاليات والانشطة الثقافية والتوعوية بمحافظات الجمهورية المختلفة بالإضافة الى تنظيم العديد من المسابقات الفنية المتنوعة على مدار الـ 16 يوم وذلك في إطار الحملة والتي تحمل شعار” كوني”، هذا بالإضافة الى اللقاءات التي عقدها المجلس مع المؤسسات التنفيذية والإعلامية والهيئات والجمعيات الأهلية المعنية في محاولة لإيجاد حلول فعلية لمناهضة كافة أشكال العنف ضد المرأة والفتاة.

كما دعت عدد من المنظمات النسائية إلى تأسيس تحالف باسم “قوة العمل من أجل قانون موحد لمناهضة العنف ضد النساء”. بهدف المطالبة من أجل تبني قانون موحد لوقف العنف ضد النساء.

واستمرارا لتفشي ظاهرة العنف ضد النساء شهدت فترة التقرير، تعرض أحدي الفتيات والتي عرفت إعلاميا باسم «فتاة المول» إلى جريمة انتقام مروعة من قبل شاب، والذي كان قد تحرش بها وتعدى عليها بالضرب قبل عامين ما أدى إلى حبسه لمدة أسبوعين في القضية رقم 12501 لسنة 2015، حيث كان الجاني يتتبع الناجية وقام في 14 أكتوبر 2017 بضربها في وجهها بسلاح أبيض «كاتر» أثناء خروجها من صيدلية بمصر الجديدة. مما تسبب لها في جرح قطعي بالوجه بطول 20 سم. طبقا للناجية، فالجاني كان يحاول ذبحها لكنها التفتت فأحدث جرح في وجهها وفر هاربا، حيث تم القبض على الجاني في نفس اليوم وحبسه أربعة أيام على ذمة التحقيق.

كما شهدت الفترة التي يغطيها التقرير قيام المحامي نبيه الوحش خلال لقاء له بفضائية العاصمة بطلب اغتصاب الفتيات اللائي يرتدين الجينز الممزق معتبرا أن ذلك واجب وطني ومؤكدا أن الفتاة التي تكشف جسدها من خلال ارتداء هذه الملابس تدعو الشباب للتحرش بها.وقد أصدرت محكمة جنح أمن الدولة طوارئ حكما بالحبس ثلاث سنوات وكفالة 10 ألف جنيه وتغريمه 20 ألف جنيه على المحامي الوحش، في التهم المنسوبة له بالتحريض عبر وسائل الإعلام على اغتصاب الفتيات قسرًا والتحرش بهن، ونشر أخبار وبيانات من شأنها تكدير السلم العام وإلحاق الضرر بالمصلحة العامة.

كما انه خلال الفترة التي يغطيها التقرير استطاعت فتاة من ضحايا التحرش الجنسي في مصر نيل حقها في عقاب رادع للمتحرش، بعد أن حكمت محكمة جنايات القاهرة بمعاقبة المتحرش بها بالسجن المشدد 5 سنوات وإلزامه بالدعوة المدنية، وتعود وقائع القضية إلى العام الماضي، إذ أصرت هند عبد الستار وهي صحفية مصرية شابة على ملاحقة المتحرش بها حتى قدمته للعدالة والمحاكمة العاجلة.

ويري تحالف منظمات المجتمع المدني انه برغم صدور استراتيجية قومية لمواجهة العنف ضد النساء لتبنى تدخلات لوقف العنف على المدى من 2015 إلى 2020، شاركت في وضعها 11 وزارة إضافة للمجالس القومية المختلفة وعدد من منظمات المجتمع المدني، إلا أن جهود التدخل لوقف العنف لازالت جهود محدودة في أقل تقدير يمكن وصفها بالجهود الخجولة والغير المؤثرة. كما انه وحتى الآن يتعثر كل من مجلس النواب ووزارة العدل وغيرهم من الأطراف المعنية في طرح قانون موحد لمناهضة العنف ضد النساء للنقاش المجتمعي في الدوائر الفاعلة المختلفة، ويبدو أنه لم تعقد الإرادة بعد على طرح وإصدار قانون لمناهضة العنف ضد النساء في عام المرأة.

5.    Fair trial guarantees

The Egyptian government received 19 recommendations related to fair trial guarantees, of which 12 were accepted in full, 5 in part, and only two were taken note of.

The Egyptian constitution provides, in its articles 96, 97, and 98 good guarantees for the right to a fair and fair trial, and the current Criminal Procedure Law sets guarantees for a fair trial, but it does not allow for an acceleration of litigation to reach a prompt justice, despite the current calls to amend the law and initiatives from ministries Concerned to submit proposals for the required amendments, but there is a strong fear that these amendments will come at the expense of fair trial guarantees.

خلال دور الانعقاد الثالث يواصل مجلس النواب مناقشته مشروع قانون جديد لأجراء تعديلات على قانون الإجراءات الجنائية، بهدف تحقيق حسن الأداء في المحاكم وسرعة إنجاز القضايا والتسهيل على القاضي والمتقاضي. وقال المستشار بهاء أبو شقه، رئيس اللجنة التشريعية بمجلس النواب، إن جملة التغييرات بالقانون بلغت ٢٧٠ مادة من جملة ٥٦٠ مادة هي مواد قانون الإجراءات الحالي، موضحًا أن مواد القانون محل الاستبدال بلغت ٩٩ مادة، بالإضافة إلى ١٥٠ مادة تم استبدالها خاصة بالتحقيق بمعرفة النيابة، كما بلغت المواد الملغاة ٢١ مادة، و٤٤ مستحدثة.

ورغم هذه المواد الدستورية التي تتوافق والمواثيق الدولية وأيضا توصيات الاستعراض الدوري الشامل إلا انه مازالت هناك بعض الانتهاكات المتعلقة بالحق في المحاكمة العادلة نتيجة استمرار العمل ببعض المحاكمات العسكرية للمدنيين رغم  قصرها وتضيق العمل بها إلا أنها تعتبر سبباً في إثارة القلق ،لاسيما في ظل فرض حالة الطوارئ.

كما يقتضي القانون الدولي تقديم المحتجزين بسرعة إلى قاض، عادة في غضون 48 ساعة، لاستعراض احتجازهم، ولكن القانون المصري لا يوفر مثل هذه الحماية. حيث يمنح “قانون الإجراءات الجنائية” المصري النيابة العامة، وليس القضاة، سلطة تجديد الاحتجاز السابق للمحاكمة في جميع القضايا الخطيرة التي تنطوي على جرائم سياسية أو متعلقة بالأمن الوطني، ما يسمح للنيابة العامة باحتجاز المعتقلين مؤقتا لمدة تصل إلى 18 شهرا، وإذا كانت الجريمة يعاقب عليها بالإعدام أو السجن مدى الحياة، لمدة تصل إلى سنتين. رغم أنه على القضاة في نهاية المطاف مراجعة اعتقال المشتبه فيه خلال هذه الفترة، إلا أن قرار تجديد الاعتقال من صلاحية النيابة العامة.

وشهدت الفترة التي يغطيها التقرير انتشار فيديو مسرب للرئيس المعزول محمد مرسي -لم يتأكد من صحته – وهو يتحدث للمحكمة بأنه حاضر كالغائب بسبب القفص الزجاجي “العازل للصوت”، المودع به خلال جلسات المحاكمة. وقال مرسي إن “الحاجز الزجاجي داخل القفص يسبب انعكاسا للصورة يصيبني بالدوار، والمحاكمة بالنسبة لي غيابية بسبب الإضاءة بالقفص”. وتابع “لا أرى هيئة المحكمة ولا تراني، أنا حاضر كالغائب، لا أسمع دفاعي إلا مُتقطعا، وكذلك الشهود، ولم أر دفاعي منذ أشهر”.

ورد عليه القاضي، قائلا له إن المحكمة تراك، وعندما لاحظت عدم سماع صوتك اليوم أمرت بإدخال مُكبر صوت. وأضاف تأكد تماما أن المحاكمة عادلة ومُنصفة، ولا علاقة لها بالسياسة، وأن المحكمة تجري طبقا للقانون، لك ولغيرك”.

كما انه خلال الفترة التي يغطيها التقرير أعلن الرئيس عبد الفتاح السيسي حالة الطوارئ في البلاد اعتبارا من 13 أكتوبر الماضي ولمدة ثلاث أشهر، بهدف الحفاظ على الأمن والاستقرار في ظل خوض الدولة حربا شرسة ضد قوى إرهابية. وهو القرار الذي أثار جدلا حول قانونيته وأسبابه، وكان الرئيس السيسي فرض حالة الطوارئ في ابريل الماضي لمدة ثلاثة أشهر في اعقاب هجومين استهدفا كنيستين بمدينتي الإسكندرية وطنطا، تبناهما تنظيم داعش الارهابي، وذلك بعد مصادقة البرلمان على هذا القرار. وتم مد حالة الطوارئ في يوليو الماضي لتنتهي في 10 أكتوبر الماضي، حيث اعتبره البعض تمديدا لحالة الطوارئ بينما يرى آخرون أنه إعلانا جديدا لحالة الطوارئ.

وعلى الرغم من عدم ورود أي شكاوى تشكل انتهاكا لحقوق الإنسان حتى الآن وفقا لحالة الطوارئ المعلنة إلا انه يخشى أن يتم انتهاكات لأي من تلك الحقوق بدعوي تطبيق حالة الطوارئ أو استخدام مواد قانون الطوارئ في التعسف ضد مواطنين أبرياء.

ويطالب تحالف منظمات المجتمع المدني بضرورة الإسراع في إصدار قانون الإجراءات الجنائية الجديد، بهدف تحقيق العدالة الناجزة، وتوفير للمتهم محاكمة عادلة ومنصفة تتوافق مع التزامات مصر بموجب القانون الدولي لحقوق الإنسان والمعايير الدولية، حيث أن القانون الحالي صدر للمرة الأولى عام 1937، وبالتالي لابد من تغييره، لمواكبة التطورات الأمنية والاجتماعية التي تشهدها مصر.

6.    Protect the peaceful assembly

قدمت للحكومة المصرية 15 توصية متعلقة بحماية الحق في التجمع السلمي قبلت 4 توصيات منها بشكل جزئي،و5 توصيات بشكل كلي، وأخذت العلم ب 6 توصيات. وقد نص الدستور في المادة 73 على أنه “للمواطنين حق تنظيم الاجتماعات العامة، والمواكب والتظاهرات، وجميع أشكال الاحتجاجات السلمية، غير حاملين سلاحًا من أي نوع، بإخطار على النحو الذي ينظمه القانون. وحق الاجتماع الخاص سلمياً مكفول، دون الحاجة إلى إخطار سابق، ولا يجوز لرجال الأمن حضوره أو مراقبته، أو التنصت عليه”.

شهدت الفترة التي يغطيها التقرير صدور قرار من رئيس الوزراء بتفويض من رئيس الجمهورية، إحالة القضايا الجديدة المنصوص عليها في قانون التظاهر 107 لسنة 2013، وقانون التجمهر 10 لسنة 1914، وقانون مكافحة الإرهاب 94 لسنة 2015، وقانون تجريم الاعتداء على المنشآت على حرية العمل وتخريب المنشآت (الاضراب) 34 لسنة 2015، إلى محاكم أمن الدولة طوارئ وذلك طوال فترة تطبيق حالة الطوارئ المعلنة في جميع انحاء الجمهورية، ولا يمكن الطعن على قرارات هذه المحاكم، ويصدق رئيس الجمهورية على أحكامها ويملك حق تخفيفها وإلغائها. ويسري القرار على الدعاوى الجديدة فقط التي لم تحل لمحاكم أخرى.

وخلال الفترة التي يغطيها التقرير، شهدت اخلاء سبيل 236 مشجعاً من جماهير نادي الزمالك، بعد حصولهم على البراءة في القضية المعروفة إعلامية بـ “قضية أحداث برج العرب”. كانت قوات أمن الإسكندرية ألقت القبض على 236 شخصًا من مشجعي نادي الزمالك، عقب انتهاء مباراة الزمالك وأهلي طرابلس الليبي، لقيامهم بأعمال عنف وشغب وتكسير المدرجات بإستاد برج العرب بالإسكندرية. وتمت إحالتهم إلى النيابة، التي نسبت لهم تهم تكسير الاستاد، وتكدير الأمن والسلم العام، والانضمام وتأسيس جماعة على خلاف أحكام القانون (أولتراس).

كما قضت محكمة النقض بقبول الطعن المقدم من الناشط السياسي أحمد دومة، على الحكم الصادر ضده بالسجن المؤبد في القضية المعروفة إعلاميا بـ«أحداث مجلس الوزراء» وإعادة محاكمته أمام دائرة أخرى بمحكمة الجنايات, وكانت محكمة جنايات الجيزة قد سبق وعاقبت أحمد دومه (حضوريا) و229 متهما بالسجن المؤبد، في حين عاقبت المحكمة 39 متهما آخرين بالسجن لمدة 10 سنوات لكل منهم، وإلزام المتهمين جميعا متضامنين بأداء مبلغ 17 مليون جنيه على سبيل الغرامة، وذلك لإدانته ومتهمين آخرين معه في القضية بارتكاب أحداث العنف وإضرام النيران والشغب أمام مباني مجلس الوزراء ومجلسي الشعب والشورى والمجمع العلمي المصري، فيما عرف إعلاميا بـ «أحداث مجلس الوزراء».

كما قضت محكمة النقض، بقبول طعن 38 متهما على خلفية اتهامهم بأحداث التجمهر التي وقعت بدمياط، وإعادة المحاكمة، وكانت محكمة جنايات دمياط قضت بمعاقبة المتهمين بالسجن 5 سنوات في إدانتهم بالتجمهر والتظاهر بدون تصريح بدمياط.

في المقابل أيدت محكمة النقض عقوبة علاء عبد الفتاح و22 أخرين -مفرج عنهم جميعا بعفو رئاسي باستثناء علاء-، في قضية “مظاهرة الشورى”، والمحكوم عليهم فيها بالحبس خمس سنوات، وغرامة 100 ألف جنيه. كانت محكمة جنايات القاهرة، قد أصدرت حكما في فبراير 2015، بمعاقبة متهمين “اثنين” من بينهما الناشط علاء عبد الفتاح بالسجن المشدد 5 سنوات، وتغريمهما 100 ألف جنيه لكل منهما، كما قضت المحكمة بمعاقبة 18 متهمًا بالسجن المشدد 3 سنوات وتغريمهم 100 ألف جنيه، إلى جانب معاقبة 3 متهمين “غيابيًا” بالسجن 15 سنة. أسندت النيابة العامة للمتهمين جرائم الاعتداء على أحد رجال الشرطة، وسرقة جهازه اللاسلكي، وتنظيم مظاهرة بدون ترخيص أمام مجلس الشورى، وإثارة الشغب والتعدي على أفراد الشرطة وقطع الطريق والتجمهر وإتلاف الممتلكات العامة.

وفي سياق أخر، شهدت الفترة التي يغطيها التقرير دخول المئات من عمال شركة غزل المحلة في إضراب مفتوح عن العمل بسبب عدم صرف العلاوة الاجتماعية بنسبة 10%، والتي أقرها مجلس النواب مؤخرا للعاملين غير الخاضعين لقانون الخدمة المدنية بالدولة. وذلك بأقسام ١ و٢ و٤ و٦ و٧ بمصنع الملابس ومصنع الملايات التابع لقطاع الملابس، والاعتصام داخل الشركة، وأبلغوا الإدارة بمطالبهم، وهددوا بالتصعيد إذا لم تتم الاستجابة لمطالبهم.

ويطالب تحالف منظمات المجتمع المدني بتعديل قانون التظاهر على نحو يتوافق مع الدستور المصري والتزامات مصر الدولية، خاصة المادة الخاصة باستخدام القوة والأسلحة النارية من قبل الموظفين المكلفين بإنفاذ القوانين، كما يطالب بوضع تعريف واضح للأحوال التي بمقتضاها يحاكم بعض الأفراد المحتجزين تحت غطاء قانون التظاهر خاصة وان القانون يمتلئ بالمصطلحات الفضفاضة التي يمكن من خلالها تنظيم الحق في التجمع السلمي،  مثل المساس بتعطيل الإنتاج أو بالدعوة إليه أو بالنظام العام أو تعطيل مصالح المواطنين أو إيذائهم أو تعريضهم للخطر أو الحيلولة دون ممارستهم لحقوقهم وأعمالهم أو التأثير على سير العدالة أو المرافق العامة أو قطع الطرق أو المواصلات، وهي مصطلحات فضفاضة يجب أن تحدد في اللائحة التنفيذية للقانون.

7.    Minority rights protection

قُدمت إلى الحكومة المصرية توصيتين فيما يتعلق بضرورة حماية حقوق الأقليات والعمل على ضمانها، وقد قبلتهـما الحكومة قبولا جزئيا. وقد نص الدستور المصري في المادة 3 على أن “مبادئ شرائع المصريين من المسيحيين واليهود المصدر الرئيسي للتشريعات المنظِّمة لأحوالهـم الشخصية، وشئونهـم الدينية، واختيار قياداتهـم الروحية”.كما تنص المادة 64، على أن “حرية الاعتقاد مطلقة. وحرية ممارسة الشعائر الدينية وإقامة دور العبادة لأصحاب الأديان السماوية، حق ينظمه القانون”.

وشهدت الفترة التي يغطيها التقرير استهداف القس سمعان شحاته كاهن كنيسة القديس يوليوس الأقفهصي، عزبة جرجس التابعة لإيبارشية الفشن بمحافظة بني سويف، على يد متشدد أثناء تواجده بالقرب من منطقة مؤسسة الزكاة بمدينة السلام بالقاهرة، والذي انهال عليه بـ (ساطور) ما أسفر عن إصابته في الرأس وطعنات بالبطن، ليلفظ أنفاسه الأخيرة. وعلى الرغم من فرار الجاني إلا أن قوات الأمن وبمساعدة الأهالي ألقت القبض عليه في غضون وقت بسيط، ليتم عرضه على النيابة مباشرة.

ومع بداية العام الدراسي الجديد واجه الطلاب الاقباط الذين هجرت أسرهم قسريا من مدينة العريش خلال فبراير الماضي، وذلك عقب استهداف مسلحين عددا من الاقباط بالقتل وحرق المنازل والممتلكات الخاصة، تجاهل من بعض المسؤولين في الدولة، الذين طالبوا أولياء أمور تلاميذ بمراحل التعليم ما قبل الجامعي بالذهاب إلى العريش وتقديم طلبات للنقل، مع الحصول على الملفات الخاصة بأبنائهم، وتقديمها في المناطق التي يعيشون بها حاليا، مما يعرضهم للخطر. مع العلم أن وزير التربية والتعليم كان قد أصدر قرارا –وقت الازمة- بقبول كافة التلاميذ الاقباط في أقرب مدارس من منطقة سكنهم الحالي بدون أي أوراق رسمية لهم، كما تم التنسيق بقبول طلاب التعليم العالي بجامعة قناة السويس وتوفير أماكن لهم بالمدينة الجامعية وتوفير الدعم اللازم لهم.

ورغم ان الدستور المصري نص على حماية حرية العقيدة، لكنه لا يوفر هذه الحرية سوى لأتباع الشرائع السماويه الثلاث وهي الإسلاميه والمسيحية واليهودية، فلهم الحق في ممارسة دينهم بحرية، وبناء دور العبادة، في الوقت الذي تواصل فيه الحكومة عدم الاعتراف بعدد من الطوائف الدينية، بما في ذلك شهود يهوه، وطائفة المورمون، والبهائيون، حيث قيدت أنشطتهم. حيث ان هذه الطوائف لا تلقي قبول مجتمعي.

ويري تحالف منظمات المجتمع المدني ضرورة تنفيذ برامج وطنية لتعزيز دور القانون والتأكيد على مسألة المساواة والمواطنة وتعزيز الاحترام والتسامح الديني والتنوع الثقافي، والتوقف عن اتباع أسلوب الجلسات العرفية في فض الخصومات الطائفية.

8.    حماية حرية الرأي والتعبير

قدمت للحكومة المصرية في هذا الشأن 11 توصية متعلقة بحماية حرية التعبير، حيث قبلت الحكومة المصرية توصية واحدة جزئيا، و7 توصيات قبول كلي، وتم أخُذ العلم ب 3 توصيات فقط.

كما أن الدستور المصري قد خص حرية الرأي والتعبير وحرية البحث العلمي وحرية الصحافة في مواده 65، 67، 70، 71 والذي تكفل كافة أشكال حرية الرأي والتعبير والإبداع الأدبي والفني وحرية الصحافة وحرية الإعلام واستقلاليتها وحظر الرقابة عليها أو مصادرتها وحرية إصدارها وحق الصحفيين في الحصول على المعلومات.

يحكم النشاط الإعلامي والصحفي في مصر عدد من الأنظمة والقوانين، بدءاً من الدستور إلى قانون تنظيم الصحافة والاعلام بالإضافة إلى قانون العقوبات وقانون الطوارئ.

وخلال الفترة التي يغطها التقرير، أصدر رئيس مجلس الوزراء، اللائحة التنفيذية لقانون التنظيم المؤسسي للصحافة والإعلام. وجاء إقرار اللائحة التنفيذية متأخرا بالمخالفة لما نص عليه القانون بإصدارها خلال ثلاثة أشهر من تاريخ العمل بالقانون.

 خلال الفترة التي يغطيها التقرير شكل المجلس الأعلى لتنظيم الاعلام لجنة لإعداد مشروع قانون حرية تداول المعلومات، وضمت اللجنة المشكلة لإعداد القانون في عضويتها 10 أعضاء، بينهم 5 من ضمن أعضاء المجلس الأعلى لتنظيم الاعلام، إضافة 3 أعضاء يمثلون الجهاز المركزي للتعبئة العامة والاحصاء ومركز المعلومات بمجلس الوزراء والجهاز القومي لتنظيم الاتصالات، وأثنين من وزراء الثقافة السابقين.

شهدت الفترة التي يغطيها التقرير فصل 4 صحفيين من جريدة اليوم السابع التابعة لشركة إعلام المصريين، وذلك على خلفية ممارسة حقهم في التعبير عن رأيهم الشخصي ووجهات نظرهم السياسية عبر حساباتهم الشخصية على مواقع التواصل الاجتماعي.

كما شهدت نفس الفترة استمرار حجب عدد كبير من المواقع الإخبارية والحقوقية من قبل الحكومة المصرية بدعوي أنها تدعوا وتحض على الإرهاب والكراهية وتهدد الأمن القومي المصري. وقد جاء هذا التحرك ضمن الحرب التي تخوضها مصر على الإرهاب والتطرف وداعميه، وباعتبار تلك الوسائل الإعلامية “توفر للمنظمات والدول والجماعات الإرهابية منصة للدعاية والترويج ومظلة للأفكار الإرهابية”، ويسمح قانون الطوارئ ، لرئيس الجمهورية بإصدار أوامر (كتابة أو شفاهية)، بمراقبة الصحف والنشرات والمطبوعات والمحررات والرسوم ووسائل التعبير والدعاية والإعلان، قبل نشرها وضبطها ومصادرتها وإغلاق أماكن طباعتها.

وعلى الرغم من أحقية الدولة في حجب تلك المواقع إلا ان تحالف منظمات المجتمع المدني، يري من الأفضل أن تكون قرارات الحجب في صورة أحكام قضائيه تصدر بحق هذه المواقع خاصة وان هناك عدد من المواقع التي تم حجبها في مصر هي مواقع إخبارية وإعلامية معارضة لبعض سياسات النظام الحاكم في مصر وتم حجبها بدون مبرر. كما يطالب التحالف بضرورة وضع وتفعيل ميثاق شرف للإعلاميين يتوافق المجتمع على أهميته للحيلولة دون حدوث الفوضى الإعلامية السائدة.

9.    Promote youth rights

شهدت الفترة التي يغطيها التقرير عقد منتدى شباب العالم خلال الفترة من 4 – 10 نوفمبر 2017، وشارك فيه آلاف من الشباب حول العالم ينتمون إلى ما يقرب من 100 جنسية، وهو الأول من نوعه، خاصة فيما يتعلق بالقضايا التي ناقشها، من بينها قضايا الإرهاب، واللاجئين، وكيف يمكن أن يسهم الشباب في بناء وحفظ السلام في مناطق الصراع، وكذا عرض عدد من التجارب الدولية في تدريب الشباب وصناعة قادة الغد، وصولا لنموذج محاكاة للأمم المتحدة، والذي شارك به أكثر من 60 شاباً من مختلف دول العالم.

كما شهدت الفترة التي يغطيها التقرير إصدار الرئيس عبد الفتاح السيسي قرار رقم 434 لسنة 2017 بإنشاء الأكاديمية الوطنية لتأهيل الشباب، باعتباره الحلقة الاحدث في مسار عملية تمكين الشباب، والتي بدأت بتخصيص عام 2016 ليكون عامًا للشباب، ثم إنشاء البرنامج الرئاسي لتأهيل الشباب للقيادة، الذي خرج دفعة أولى مكونة من 500 شاب وفتاة، ويستعد لتخريج الدفعة الثانية، بينما تجرى حاليا عمليات اختيار المشاركين في الدفعة الثالثة للبرنامج.

رغم ذلك لازالت الأوضاع الاقتصادية تلقي بظلالها على الشباب ، حيث لم تشهد معدلات البطالة في صفوفهم انخفاضا ملحوظا ، ولا زالت العوائق الإدارية والروتين الحكومي يحرم قطاعات واسعة منهم من الاستفادة من فرص تمويل المشروعات التي أتاحتها الدولة منذ ثلاثة أعوام ،  فضلا عن ذلك فإن شباب الجامعات لم يحصلوا على حقوق ملموسة فيما يتعلق بالمشاركة في عملية الإدارة من خلال الاتحادات الطلابية  التي شهدت انخفاضا شديدا في الإقبال عليها خلال الفترة التي يغطيها التقرير كنتيجة لعدم ملاءمة اللائحة المعمول بها حاليا ، فضلا عن تقييد الممارسة السياسية في الجامعة بدعوى الفصل بين العمل الحزبي والتعليم .

ويري تحالف منظمات المجتمع المدني بضرورة فتح قنوات تواصل دائم بين القيادة السياسية والشباب، وتمكينهم سياسياً، واقتصادياً، ومجتمعياً. كما يطالب بسرعة إجراء انتخابات المحليات التي ستضمن تمثيلاً كبيراً للشباب.

10. تعزيز حقوق المرأة

قدمت للحكومة المصرية 39 توصية متعلقة بتعزيز حقوق المرأة، وقد قبلت الحكومة منها 35 توصية بشكل كلي، كما قبلت 3 توصيات بشكل جزئي، وأخذت العلم بتوصية واحدة فقط. وقد تضمن الدستور المصري عدة مواد تعزز حقوق المرأة ومساواتها بالرجل كالمادة 11 التي تكفل تحقيق المساواة بين المرأة والرجل في جميع الحقوق المدنية والسياسية والاقتصادية والاجتماعية والثقافية، والمادة 180، التي تضمن تمثيلا عادلا للنساء في المجالس المحلية.

وخلال الفترة التي يغطيها التقرير ناقش مجلس الوزراء استراتيجية تمكين المرأة 2030، وآليات تنفيذ الاستراتيجية ومحاورها الاقتصادية والاجتماعية والحماية ومحور التشريعات والتوعية بهدف الوصول إلى أكبر عدد من السيدات، وقد قدمت مايا مرسي أمين عام المجلس القومي للمرأة، كشف حساب للمجلس القومي للمرأة عن الفترة الماضية، حيث قالت وصلنا إلى ٢ مليون و٦٤٦ ألف سيدة مستفيدة من برامج المجلس القومي للمرأة في جميع المحافظات، ومن خلال طرق الأبواب، وصلنا إلى مليون و١٥٥ ألف مستفيدة في ١٣٨٤ قرية، وتم استخراج بطاقات الرقم القومي ل ٣٢٢ ألف سيدة ، وتم تدريب ١٨٤٣٢ فتاة على لريادة الأعمال.

كما شهدت هذه الفترة موافقة مجلس النواب على تعديل “قانون المواريث” لينص على حبس من يحرم الأنثى من ميراثها أو حقوقها العامة والخاصة أو ارتكب فعلاً عنيفا ضدها. وذلك من خلال إضافة باب تاسع بعنوان “العقوبات” للقانون رقم 77 لسنة 1943، يتضمن مادة جديدة برقم 49 تحدد عقوبات من يمتنع عن تسليم الميراث للورثة.

وشهدت الفترة التي يغطيها التقرير إصدار قرار من وزير الداخلية بإنشاء قسم جديد للإناث للعمل كمعاونات أمن في معهد معاوني الامن بالقاهرة، يخضع للإشراف المباشر من قائد المعهد، ويتبع معهد معاوني الأمن، مما يشكل خطوة جيدة لتمكين المرأة في مجالات العمل العام كافة.

كما انه خلال فترة التقرير، أصدر قطاع التنمية والخدمات بوزارة التعليم العالي تقريرا يستعرض وجود المرأة في الوزارة ممثلة في كل القطاعات والمناصب القيادية.

في المقابل شهدت انتخابات الأندية الرياضية التي جرت خلال فترة كتابة التقرير، تمثيل ضعيف لمشاركة النساء في انتخابات مجالس إدارات النوادي، حيث جاءت قوائم الترشحات أغلبها من الرجال أما النساء لا يزيد نصيبهن عن مقعد واحد – إن وجد – وفى حالات نادرة قد يصل إلى مقعدين.

كما أن الفترة التي يغطيها التقرير شهدت قيام الأستاذة المحامية أمنية جاد الله دفعة 2015 والحاصلة على ماجستير في القانون العام  برفع دعوي قضائية أمام المحكمة الإدارية العليا، حول استحقاقها للتعيين بمجلس الدولة كمندوب مساعد يمكنها بالترقي لاحقا وحسب شروط التعيين والتوظيف من الوصول لمنصة القضاء بمجلس الدولة، وتمثل هذه القضية خطوة جديدة في طريق نضال النساء من أجل حصولهن على حقوقهن في مواجهة تعنت مستمر من جانب بعض الهيئات القضائية في مصر، وإصرارها غير المبرر على عدم حصول النساء على هذا الحق، وهو موقف يتناقض مع مبدأ المساواة بين النساء والرجال المنصوص عليه في الدستور.

وعلى الرغم من النجاحات التي تحققت خلال عام المرأة في مجال تعزيز حقوق المرأة وتمكينها لا تزال هناك العديد من القوانين التي تكرس التفاوت وسياسة التمييز بين الرجل والمرأة في كثير من القضايا والحقوقومن تلك القوانين موضوع الحماية الجنائية، وقضايا الأحوال الشخصية، والشهادة في المحاكم، وكذلك القوانين العقابية التي لازالت تجيز تأديب الزوج لزوجته بحجة استعمال الحق، بالإضافة إلى استخدام مبدأ الرأفة مع الرجل في جرائم القتل تحت مسمى جرائم الشرف، والتي بناء عليها ينتهك حق المرأة الضحية  في الحياه . كما أنه ما تزال نسبة تمثيل المرأة في المناصب السياسية والتنفيذية والقضائية محدودة للغاية فهناك 4 وزيرات فقط من إجمالي 34 وزير، فضلا عن الضعف الشديد في نسبة العاملات من شاغلي الوظائف القيادية في المؤسسات الحكومية. كما أن نسبة تعيين القاضيات في الجهات والهيئات القضائية لا تليق بمكانة وتاريخ المرأة المصرية ونضالها، خاصة إذا ما قورنت بنسب تعيين المرأة في الجهات والهيئات القضائية في الدول العربية والافريقية والأجنبية، والتي وصلت المرأة فيها الى أعلى المناصب بالكادر القضائي.

يطالب تحالف منظمات المجتمع المدني، بإجراء مسحي شامل للمواد القانونيه في القوانين المختلفة التي تميز بين الرجل والمرأة، وتعديل هذه التشريعات لإقرار المساواة بين الجنسين في الحقوق والواجبات. وإيجاد آليات حقيقية لمكافحة ظاهرة التمييز ضد المرأة، وخلق الوعي لدى الرأي العام لفهم وتغيير التقاليد الموروثة المسيئة للمرأة.

11. مناهضة التعذيب

قدمت للحكومة المصرية 11 توصية متعلقة بمناهضة التعذيب، قبلت الحكومة المصرية 9 توصيات ورفضت اثنتين، وتنص المادة 52 من الدستور على أن “التعذيب بجميع صوره وأشكاله، جريمة لا تسقط بالتقادم”. وكذلك المادة ٥١ “الكرامة حق لكل إنسان، ولا يجوز المساس بها، وتلتزم الدولة باحترامها وحمايتها”. ثم بما كان في المادة ٥٥ من تفصيل “كل من يُقبض عليه، أو يُحبس، أو تُقيد حريته تجب معاملته بما يحفظ عليه كرامته، ولا يجوز تعذيبه، ولا ترهيبه، ولا إكراهه، ولا إيذاؤه بدنيًا أو معنويًا، ولا يكون حجزه، أو حبسه إلا في أماكن مخصصة لذلك لائقة إنسانيًا وصحيًا، وتلتزم الدولة بتوفير وسائل الإتاحة للأشخاص ذوي الإعاقة. ومخالفة شيء من ذلك جريمة يُعاقب مرتكبها وفقا للقانون.وللمتهم حق الصمت. وكل قول يُثبت أنه صدر من محتجز تحت وطأة شيء مما تقدم، أو التهديد بشيء منه، يُهدر ولا يُعَول عليه”.

من الملاحظ انخفاض معدل قضايا التعذيب في مصر خلال السنوات الأخيرة، فمنذ عام 2014 كانت كل البلاغات الخاصة بالتعذيب موضع تحقيق، كما أنه منذ منتصف 2015 وحتى منتصف 2016 كان هناك 3 حالات فقط موثقة عن الوفاة نتيجة تعذيب، وكان هناك إجراءات محاسبة وإحالة المتهمين للمحاكمة، ومنذ منتصف 2016 وحتى نهاية عام 2017 تم توثيق حالة واحدة، غير ان الفترة التي يغطيها التقرير شهدت بعض حالات الوفاة داخل اقسام الشرطة ويمكن ذكرها فيما يلي:

§        في ديسمبر 2017، اتهمت أسرة إسلام زكي الوكيل، قيادات قسم شرطة شبين القناطر بالتسبب في مصرع ابنهم متأثرا بإصابات متفرقة في جسده، جراء تعرضه للتعذيب داخل القسم، وطالبوا بفتح تحقيق في الواقعة، وكانت قوات الامن ألقت القبض على إسلام لاتهامه بالضلوع في واقعة سرقة مسكن ربة منزل بشبين القناطر.

§        في نوفمبر 2017، تعرض أحد المحتجزين، على ذمة قضية تعاطي مخدرات للإصابة بهبوط في حاد في الدورة الدموية داخل قسم شرطة مصر الجديدة، وتم نقله إلى المستشفى لإسعافه، ولكنه لفظ أنفاسه الأخيرة، تحرر محضرا بالواقعة، وتولت نيابة مصر الجديدة التحقيق.

§        في أغسطس 2017، توفي كامل جمال داخل مركز الفتح بمحافظة أسيوط عقب القبض عليه، على خلفية سرقة دراجة نارية من مواطن بمدينة أسيوط، هناك تحقيقات تجرى بمعرفة النيابة والجهات الأمنية في واقعة وفاة الشاب.

§        في أغسطس 2017 أيضا، لقي أحمد.ت.إ 63 سنة سائق مصرعه محكوم عليه بالسجن 3 أشهر لاتهامه في جنحه، إثر إصابته بحالة إعياء شديد بقسم شرطة ثان بمحافظة أسوان، نتيجة التكدس والازدحام الشديد وانعدام التهوية داخل الزنازين وتركه يصارع الوجع والألم لساعات طويلة دون نقله للمستشفى لتلقي العلاج، وتحرر بلاغ بالواقعة وتولت النيابة التحقيق.

ويمكن القول أن الإطار القانوني الذي يجرّم التعذيب في مصر لا يزال غير كاف ولا يفي بالتزامات مصر الأساسية بموجب القانون الدولي، مما يسمح للضباط والعناصر المسيئين – وأن كانت نسبتهم ضئيلة – بالتهرب من العدالة، كما أن تعريف التعذيب في المادة 126 من قانون العقوبات يجب تعديله ليتماشى مع “اتفاقية الأمم المتحدة لمناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، وأيضاً تشديد العقوبات في المادة 129 المتعلقة باستخدام المسؤولين للعنف، وزيادة العقوبات المنصوص عليها في المادة 282 المتعلقة بالتعذيب أثناء الاحتجاز غير القانوني من أجل جعل هذه العقوبات تتناسب مع خطورة الجرائم.

ويري تحالف منظمات المجتمع المدني ضرورة اتخاذ خطوات حقيقية لمنع العنف والتعذيب قبل وقوعه ومحاسبة المتورطين فيه، وتعديل المواد المتعلقة باستخدام القوة في قانون هيئة الشرطة، كذلك التعامل بجدية مع الشكاوى المقدمة ضد الموظفين المكلفين بإنفاذ القانون والتحقيق الفوري في الادعاءات المتعلقة بالتعذيب.

12. Anti-corruption

§        The Administrative Control Authority has arrested a general manager of the Procurement Department at the General Organization for Export and Import Control, on charges of taking a 350,000 EGP bribe from the owner of a private supply company working in the field of laboratory equipment.

§        The authority also arrested two offers of 4.5 million pounds as a bribe to the first president of Al-Salam neighborhood in Cairo governorate, in exchange for using his job authorities to finalize the procedures for extracting the validity of the site for an infringement plot of 5 acres owned by the Egyptian Endowments Authority and the current market value of about 350 million Egyptian pounds. 14. Promote human rights-of-law enforcement practices

The formation of each of them, its competencies, and guarantees of independence and impartiality of its members, and it has the right to inform public authorities of any violation related to its field of work. These councils have legal personality, technical, financial and administrative independence, and their opinion is taken in draft laws, regulations related to them, and their field of work.

During the period covered by the report, President Abdel Fattah Al-Sisi issued a presidential decree Law No. 197 of 2017 amending some provisions of Law No. 994 of 2003 establishing the National Council for Human Rights.The law stipulates that it shall be replaced by the texts of Articles 1, 2, 3, 7, 9, 10, 12 and 13 of Law No. 94 of 2003 establishing the National Council for Human Rights. Parliament had approved the amendment of the National Council for Human Rights Law, and the amendments increased concerns about the council’s future performance, and that it would lead to diminishing its independence and impartiality, as some jurists see it as against international conventions and will reduce its global level, and the article related to With the possibility of dismissing members of the National Council for Human Rights by a decision of the House of Representatives, there is no explanation for the reasons for this separation, and so that this amendment allows Parliament to punish a member of the Council for his opinion with dismissal from membership of the National Council for Human Rights. The Civil Society Organizations Coalition believes that the effective promotion and protection of human rights requires the involvement of all actors and coordination between them at the national and international levels, governmental sectors, parliament, civil society, the media, governmental institutions and international bodies in charge of human rights..Consequently, coordination must be made between the Council and governmental and non-governmental agencies to promote and develop the protection of human rights in Egypt.

16. Ensure the right to access drinking water and sanitation services

I made one recommendation to the Egyptian government in this regard, and the government has already accepted it. The Egyptian constitution does not contain explicit articles regarding the right of citizens to obtain drinking water and sanitation services, but this right is implicitly guaranteed in Articles 18 related to the right to health care, 78 related to guaranteeing the right. 18. Combating human trafficking and illegal immigration

19. Promote human rights education programs

It presented 11 recommendations to Egypt in the context of the issue of promoting human rights education, as the Egyptian government fully accepted 10 recommendations and took note of only one recommendation. Article 24 of the constitution stipulates that “universities shall work to teach human rights.”

20. Promote the right to social security

Three recommendations were submitted to Egypt related to the right to social security and were accepted by the Egyptian government. The Egyptian constitution states in Article 8 that “society is based on social solidarity. The state is committed to achieving social justice and providing means of social solidarity, in a way that guarantees a decent life for all citizens, in the manner organized by law.

The Egyptian government implements social protection programs with the aim of improving the standard of living of the most vulnerable, by expanding the number of beneficiaries of the “Takaful and Karama” program to give monthly aid to eligible groups in the various governorates.

The period covered by the report witnessed the expansion of the umbrella of social protection through an increase in the number of beneficiaries of the cash support program “Takaful and Karama”, as 4.6 million families were registered in the program, including 19.1 million individuals.. 21. Improving the work environment for civil organizations

20 recommendations were submitted to Egypt in the framework of the issue of improving the civil work environment. The Egyptian government partially accepted 6 recommendations, 12 recommendations were fully accepted, and two recommendations were taken into account. The Egyptian constitution stipulates in Article 75 that “Citizens have the right to form associations and civil institutions on the basis of Democratic, and shall have legal personality upon notification. The session ended with the referral of the appeal to the Commissioners 'Commission, which included the appellants' submission of several requests to the court, the most important of which is the obligation of the President of the Court of Appeal (the defendant) to submit the mandate of the General Assembly to the Cairo Court of Appeal for him in its jurisdiction to delegate the investigative judges, as well as to submit a copy of his decisions to delegate - and renew the mandate of the counselor. The period covered by the report witnessed the continuing crisis of a shortage of several types of medicines, amid citizens' complaints about the unavailability of their drug needs in pharmacies, despite official assurances that large quantities are being pumped to fill the deficit., Where The shortage of the long-acting penicillin drug, which is used for patients with rheumatic fever, continued in pharmacies,The same period also witnessed the emergence of complaints about the poor health services in public and state-owned educational hospitals, which were represented by the shortage of doctors, the shortage of medicines and worn out devices.

The coalition of civil society organizations calls on the Egyptian government to adopt a clear vision for education reform, as well as to expedite the issuance of the health insurance law.

23. Respect for religious tolerance and cultural diversity

Egypt has presented 11 recommendations related to the respect and encouragement of dialogue initiatives and religious tolerance, and the Egyptian government has accepted them all. The Egyptian constitution includes multiple articles that establish the idea of citizenship and equality between citizens regardless of their religion, but it does not include specific articles that reinforce the state’s role in integrating the values of dialogue and religious tolerance and encouraging Relevant initiatives, although official political discourse repeatedly emphasizes these issues.

24. Promote corporate social responsibility

Egypt has received 4 recommendations in the context of this issue and has accepted them all. "Article 36 of the Constitution stipulates that the state shall stimulate the private sector to fulfill its social responsibility in serving the national economy and society."

And despite the issuance of Law 72 of 2017, which approved in Article 15 of it the role of companies in social responsibility to achieve the goals of comprehensive and sustainable development by allocating a percentage of their annual profits to be used in establishing a community development system, outside of its investment project, through its participation in a number of development areas .

However, the failure to pass laws that allow the transparent announcement of various government policies, which allows providing information, improving government systems in various bodies and departments, and encouraging partnership between the public and private sectors to carry out their social responsibility towards various stakeholders through the necessary incentives and privileges for government tenders for a specific period and linking them to achieving social goals Specifically, it constitutes an obstacle for companies to fulfill their responsibilities towards society.

The Civil Society Organizations Coalition calls for the need to improve legislation and legal procedures to advance corporate social responsibility, and to establish an institutional unit at the Ministry of Investment to educate investors and society about social responsibility, in addition to establishing a database that includes local needs that is updated annually at the governorate level. And work to build the capacity of employees working on the file of social responsibility and educate the investor of his role through development plans in the provinces, and coordination between civil society forces working on the issue.

25. Ensure the right to economic development

Egypt has submitted 11 recommendations in this regard and they have all accepted them. Article 236 of the constitution stipulates that “the state shall guarantee the formulation and implementation of a comprehensive economic and urban development plan for border and deprived areas, including Upper Egypt, Sinai, Matrouh and the Nuba regions.” Article 238 states the objectives of the tax system that Centered on achieving economic development.
