Implications of postponing local elections

The first seminars of the Forum (Maat for Political and Legislative Reform), which revolved around the implications of postponing local elections, were held at the headquarters of the Maat Center for Human Rights and Constitutional Studies, and were attended by:
Mr. Abdul Ghaffar Shukr, member of the political bureau of the Tagammu Party
Mr. Subhi Saleh, member of the People's Assembly and a member of the General Syndicate of Lawyers
Dr. Jihad Odeh, Head of Political Science Department, Helwan University
The workshop was moderated by Mr. Ayman Aqeel, Director of the Center
Which presented the reasons put forward by the government to postpone the elections, which were represented in providing the opportunity to complete constitutional amendments and legislative reforms and amending the Local Administration Law to support decentralization in decision-making.

He posed many questions to the guests, including whether the elections were postponed to give the National Party an opportunity to prepare expertise and cadres capable of facing the rise of the Muslim Brotherhood? Can the Muslim Brotherhood establish a political party? Is it really true that the government is unable to hold local elections and mid-term renewal of the Shura Council? Although in 2005 it carried out the referendum, the presidential elections and the parliamentary elections in its three stages !!!
In his speech, Professor Abdel Ghaffar supported the decision to postpone the elections for more than one reason, including:
Egyptian society, within 6 months, cannot bear holding another election after the violence that occurred in the People's Assembly elections.
The Brotherhood has demonstrated its ability to mobilize and the possibility of desperate voters in front of the committees and achieving success and the possibility of achieving greater success in the localities, which allows the nomination of one of the brothers in the presidential elections.

(Abd al-Ghaffar) confirmed that the advertiser is not far from the truth that the government is in the process of reforms in the constitution and local administration laws that give more possibility to localities.

He emphasized that political reform does not begin without constitutional reform.

At the end of his speech, he stressed that the local administration system is ineffective and that we want a real local government system based on:

Electing localities in open proportional lists to represent political forces, not families, because local councils are the primary school for practicing democracy.

That its decisions be enforceable, and it has the right to withdraw confidence from the executive leadership in the form of an interrogation

That the leaders of the executive bodies be elected so that they belong to the voters and not to the authority that appointed them.

Expanding decentralization.

In a speech, Mr. Subhi Saleh explained how this law was passed:

He said, the government presented a one-article bill and attached to it an explanatory memorandum for the reasons for the two-page postponement. The decision of the Local Administration Committee of the Shura Council ended in one day and submitted it to the People's Assembly directly to issue the decision on the same day.
He explained that the government cited two reasons for the delay:
The government is in the process of constitutional amendments dealing with the local administration law.
It cannot hold local elections to contemplate it with the mid-term renewal of the Shura Council, which contradicts it.
Professor Subhi asserted that this contradicts the constitution, and that legislation is defective when it is biased and biased. The situation is in favor of himself over a period of time, and he stressed that it is not permissible to disrupt reality with imagination and certainty of doubt.
Who knows that the upcoming constitutional amendments will include amending the Localities Law? Who knows that the upcoming constitutional amendments will follow the pattern of Article 76?

At the end of his speech, Sobhi assured that if the NDP did not engage in politics, it would lose.

If he does not respect the other, the remaining party will lose its balance, and if it does not allow itself to listen to others, it will lose.

If he continues to advance the interest of the party over the interest of the nation, then he is risking the country, so he practices political suicide.

Dr. Jihad Odeh emphasized in his speech:

That local elections are part of the executive authority and not the legislative authority, and there is sensitivity about an attempt to remove it from the executive to the legislative to become part of the legislative authority. We have practiced it as legislative and then constitutionally challenged it that this is not permissible according to the text of the constitution and the constitutional rule paralyzes our hand.

He emphasized that a distinction must be made between the logic of law and the logic of politics, and that the logic of law is not the right or the logic of politics is the right. They are two different logics.

Hence the idea of why the local elections were postponed ?? The postponement was until we reached that the law was in accordance with the policy

Dr. Jihad emphasized the restructuring of the political system in Egypt, so restructuring it to allow harmony between politics and the law, and indicated that the majority system is not based on the distribution of spoils in any parliamentary system.

The practice of majority rule is a sound practice that does not express the political suicide mentioned by Mr. Sobhi Saleh.

In the end, Dr. Jihad emphasized that the postponement is a good democratic reform decision to prevent any illegal practices.

Politics is a game of long-term expectation and not complaining about small issues or illusions.

In response to the questions of the participants in the seminar, why did the Brotherhood not submit a request to establish a political party, Mr. Sobhi Saleh replied that the Brotherhood would not submit a request to the party committee consisting of the National Party to decide whether it would accept or reject, and the Brotherhood would not have a party unless the political parties ’law was amended. Political affairs, the abolition of the Political Affairs Committee, and that the establishment of the party should be by monopoly only, and that the Brotherhood has a bill to do so.

In response to a question addressed to Professor (Abd al-Ghaffar Shukr) about why there is no role for the Tagammu Party in the Egyptian street, he attributed that to two factors, the first of which is preventing parties from engaging in mass political activity.

The second is that the leaders of the group neglected to form a new generation of youth.

At the end of the episode, Ayman Aqil, Director of the Center emphasized the necessity of completing the constitutional and legislative reforms that included consolidating democracy, exercising freedoms, real opposition and party pluralism, and that state institutions would proceed in the path of reform instead of going backward.
