Corruption is rife within the judiciary in Somalia

Hajar Abdel Monsef: The Somali government has failed to reform the justice sector, and citizens are resorting to customary courts 

Maat Foundation for Peace, Development and Human Rights presented today, before the Human Rights Council, an intervention on the independence of the judiciary in Somalia, within the framework of the 41st session of the Council currently held in Geneva, which is scheduled to last until July 12, 2019.

The intervention institution began by welcoming the report of the Special Rapporteur on the independence of judges and lawyers, then moved to the status of the judiciary in Somalia, where it focused on the corruption that is spreading within the judiciary, the ineffectiveness of civil courts in practice, as well as the overlap between the judiciary and other authorities in the state. The Foundation stated that the court system is weak and deficient, and does not meet the needs of citizens in many areas.

Hajar Abdel Monsef, Head of the African Affairs and Sustainable Development Unit at Maat Foundation, said that there is a state of mistrust in the government judiciary, which has led to citizens resorting to customary courts, especially in the areas controlled by the “terrorist” Youth Mujahideen Movement, as well as the government's failure so far to implement The London conference statement calling, in some of its outcomes, for reforms in the justice sector.

In conclusion, the Foundation called during the intervention, the Special Rapporteur and the Human Rights Council, to provide assistance to the Somali government in order to work on the independence of the judiciary, as it indicated the need for the judiciary for many reforms such as training workers in judicial institutions, and working to provide the necessary funding in order to restore the infrastructure of judicial facilities Of court buildings and other things, which were destroyed by wars and internal conflicts.

It is noteworthy that the Maat Foundation participates in the work of the 41st session of the Council's work with an international mission consisting of 26 individuals from 8 European and African countries, in addition to Egypt, the mission includes the countries of Turkey, Italy, Switzerland, Latvia, Romania, Somalia and Kenya, and Maat holds a number of seminars and meetings on the sidelines of the session.
