A written transcript about the independence of the judiciary and lawyers in Somalia

Submitted to: Human Rights Council 41st session

Concerning: Item 3: Interactive dialogue with the Special Rapporteur on the independence of the judiciary and lawyers

Maat Foundation for Peace, Development and Human Rights (Egypt) presents this written intervention on the situation of the judiciary in Somalia. In which the justice system suffers; Other rights systems in the country also suffer. This decline in the judicial system as a whole is the result of several factors, the most important of which is corruption that is spreading in state institutions, as well as the lack of separation of powers that allows the judicial authority to perform its role with complete independence, as well as the weakness and wear of federal and regional courts, and their submission to the control of custom more than constitutional laws. In addition to its lack of logistical matters that qualify it to perform its role effectively.
